Terms of Service

1. Acceptance of Terms

By accessing or using any service provided by National Weather Network, LLC ("NWN," "we," "us," or "our") — including the nationalweathernetwork.com website, any NWN-branded or affiliate-branded mobile application (iOS and Android), and any NWN-branded or affiliate-branded over-the-top ("OTT") streaming application (collectively, the "Services") — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.

2. Description of Services

NWN operates a network that connects viewers with local meteorologists and weather organizations ("Affiliates"). Our Services include:

  • The NWN website at nationalweathernetwork.com
  • Mobile applications published by NWN or on behalf of NWN Affiliates
  • OTT applications (e.g., Roku, Apple TV, Amazon Fire TV, Android TV) published by NWN or on behalf of NWN Affiliates
  • Live weather streams, meteorologist profiles, coverage maps, and related content

Some applications may be published under the name or branding of an NWN Affiliate. Even when branded by an Affiliate, these applications are developed, operated, and maintained by NWN and are subject to these Terms.

3. Eligibility

You must be at least 13 years of age to use the Services. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Services, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

Certain features may require you to create an account. You agree to provide accurate, current, and complete information, and to keep your credentials confidential. You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized use.

5. Affiliate Meteorologists & Organizations

NWN Affiliates are independent meteorologists and weather organizations that participate in the NWN network. NWN does not control the editorial content of Affiliate forecasts or streams. NWN is not liable for the accuracy, completeness, or reliability of Affiliate-provided weather information. All weather data is for general informational purposes only and should not be relied upon for emergency decisions.

6. Intellectual Property

All content, trademarks, logos, software, and design elements within the Services are the property of NWN or its licensors. You may not copy, distribute, modify, or create derivative works from any part of the Services without prior written consent. Affiliate content remains the property of the respective Affiliate, licensed to NWN for display within the Services.

7. Prohibited Conduct

You agree not to:

  • Use the Services for any illegal or unauthorized purpose
  • Interfere with or disrupt the Services or connected networks
  • Scrape, crawl, or use automated tools to extract data without written permission
  • Transmit any malware, viruses, or harmful code
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to any system or account
  • Circumvent any access or usage restrictions

8. Content & Streams

The Services may include live weather streams, pre-recorded content, maps, forecast graphics, and other media. This content is provided "as is" for informational purposes only. NWN does not guarantee uninterrupted access to live streams or the accuracy of any weather data. In severe weather situations, always follow official guidance from the National Weather Service (NWS) and local emergency management.

9. Mobile & OTT Applications

NWN may publish mobile and OTT applications on behalf of its Affiliates. By downloading or using any such application — whether branded as NWN or an Affiliate — you acknowledge that:

  • The application is operated by NWN and governed by these Terms
  • App store terms (Apple App Store, Google Play, Roku, Amazon, etc.) also apply to your use
  • NWN may collect usage data as described in our Privacy Policy
  • Application availability may vary by platform and region
  • Updates may be required for continued use

10. Third-Party Services

The Services may contain links to or integrations with third-party websites, services, or content. NWN does not endorse and is not responsible for any third-party content, terms, or practices. Your interactions with third parties are solely between you and the third party.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NWN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY WEATHER INFORMATION WILL BE ACCURATE OR RELIABLE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NWN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NWN'S TOTAL LIABILITY SHALL NOT EXCEED $100 USD.

13. Indemnification

You agree to indemnify and hold harmless NWN, its Affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another.

14. Termination

NWN may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
